They are seeking damages from Booking Holdings that, according to the organisers' estimates, could reach several billion euros.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">European hoteliers are stepping up legal pressure on Booking.com. A total of 18,135 hotels have joined the class-action lawsuit against its parent company, Booking Holdings, and <a href=\"https:\/\/www.hotrec.eu\/en\/news_over-18-000-european-hotels-to-pursue-landmark-collective-action-against-booking-holdings.html\">the last group of participants<\/a> It was officially filed with the District Court in Amsterdam on 30 October 2026.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The lawsuit concerns contractual provisions under which Booking.com, for two decades, restricted hotels' ability to offer lower accommodation rates on their own websites or other sales channels.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hoteliers claim that they have suffered financial losses as a result of such business practices, among other things due to limited opportunities to attract direct bookings and reduce distribution costs. <\/p>\n\n\n\n<h2 id=\"h-broj-hotela-ukljucenih-u-tuzbu-snazno-porastao\" class=\"wp-block-heading\">The number of hotels included in the lawsuit has risen sharply.<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">When the process began in January 2026, 3,087 hotels took part. By July the number had risen to 10,783, and by the end of October it had reached 18,135.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In just three months, the number of participants increased by 68 per cent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The process is coordinated by the Dutch non-profit foundation Stichting Hotel Claims Alliance (SHCA), with the support of the European Hotel and Restaurant Association (HOTREC) and more than 30 national trade associations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to SHCA's estimate, the total compensation claims could reach several billion euros, including accrued interest. However, this is the claimant organisation's estimate, not the amount already determined by the court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The first court hearing is expected during 2027. <\/p>\n\n\n\n<h2 id=\"h-zasto-su-klauzule-o-paritetu-cijena-bile-sporne\" class=\"wp-block-heading\">Why were the price parity clauses controversial?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The central issue was the so-called price parity clauses, that is, contractual provisions on price parity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They restricted hotels' freedom to set prices on different sales channels.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Until 2015, Booking.com used a broader version of those provisions, which prohibited hotels from offering a lower price on their own websites or on competing booking platforms. After that, a narrower version was applied, primarily aimed at restricting lower prices on the hotels' own sales channels.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For hoteliers, such a model was particularly problematic. Direct booking generally allows them to avoid the commission they pay to the intermediary platform, but contractual restrictions reduced the scope for offering guests a more favourable price.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An important legal basis for the current proceedings is the judgment of the Court of Justice of the European Union of September 2024. The Court found that broad and narrow price-parity clauses cannot be automatically justified as necessary restrictions for the functioning of a booking platform.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That judgment did not, in itself, determine the amount of damages nor automatically entitle every hotel to compensation. It is precisely these issues that will be the subject of further court proceedings. <\/p>\n\n\n\n<h2 id=\"h-sto-tuzba-znaci-za-buduci-odnos-hotela-i-ota-platformi\" class=\"wp-block-heading\">What does the lawsuit mean for the future relationship between hotels and OTAs?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The dispute comes at a time when European regulation is seeking to strengthen the position of business users of large digital platforms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In 2024, Booking.com had to align its business with the European Digital Markets Act (DMA), which further restricted its ability to impose price parity on hotels.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, removing the disputed provisions does not resolve the issue of any potential damage incurred in previous years.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For hoteliers, it is also a broader question of control over sales. Booking platforms remain an important source of demand, especially for smaller and independent hotels that lack strong in-house marketing channels. At the same time, the ability to set prices independently, offer special deals and incentives for direct bookings is crucial for managing revenue and distribution costs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">HOTREC President Alexandros Vassilikos said that the mass participation of hotels shows how important fair market competition and freedom of pricing are for European hospitality. <\/p>\n\n\n\n<h2 id=\"h-milijarde-eura-odstete-jos-su-neizvjesne\" class=\"wp-block-heading\">Billions of euros in compensation remain uncertain<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The court in Amsterdam has yet to establish liability and any potential financial damages. The number of hotels involved indicates the scale of dissatisfaction within a segment of the European hotel industry, but it does not mean that all participants will be entitled to compensation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is a procedure that could have consequences beyond the relationship between Booking.com and its hotel partners.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Namely, a potential court ruling on damages could affect the way hotels and major online travel agencies negotiate distribution terms, commissions and price controls in future.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So far, it has been confirmed that SHCA has submitted the third and final group of registered hotels.
