Diese Verordnung, die erstmals im Jahr 2015 verabschiedet wurde, zeigte w\u00e4hrend des Zusammenbruchs von Thomas Cook und der COVID-19-Pandemie eine Reihe von M\u00e4ngeln auf, insbesondere im Hinblick auf R\u00fcckerstattungen und Haftungsfragen innerhalb der Kette der Dienstleister.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-glavne-novosti-u-direktivi\">Wesentliche \u00c4nderungen in der Richtlinie<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Ziel der \u00c4nderungen ist es, einen besseren Schutz f\u00fcr Reisende zu gew\u00e4hrleisten und gleichzeitig die Verantwortung gleichm\u00e4\u00dfiger auf Reiseveranstalter, Reisevermittler und Dienstleister zu verteilen. Die wichtigsten Neuerungen sind:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Klare Fristen f\u00fcr R\u00fcckerstattungen<\/strong> Passagiere,<\/li>\n\n\n\n<li><strong>das Recht, zwischen Bargeld und Gutscheinen zu w\u00e4hlen<\/strong>, wobei im Falle einer Insolvenz Gutscheine gesichert werden sollen,<\/li>\n\n\n\n<li><strong>Weit gefasste Definition des Pauschalurlaubs<\/strong> um ein breiteres Leistungsspektrum abzudecken,<\/li>\n\n\n\n<li><strong>Verbindliches Beschwerdeverfahren<\/strong> beim Reiseveranstalter.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-stavovi-i-zabrinutosti-ectaa-e\">Die Standpunkte und Anliegen der ECTAA<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Der verabschiedete Vorschlag stie\u00df auf Reaktionen. <strong>Europ\u00e4ischer Verband der nationalen Verb\u00e4nde der Reiseb\u00fcros und Reiseveranstalter (ECTAA)<\/strong>. Obwohl sie die Bem\u00fchungen zur St\u00e4rkung des Verbraucherschutzes begr\u00fc\u00dfen, warnen sie vor einer Reihe von Herausforderungen:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Risiko einer Marktfragmentierung<\/strong> \u2013 Da es den Mitgliedstaaten \u00fcberlassen bleibt, ihre eigenen nationalen Vorschriften f\u00fcr Vorauszahlungen festzulegen, k\u00f6nnten Reiseveranstalter je nach dem Land, in dem sie t\u00e4tig sind, benachteiligt werden.<\/li>\n\n\n\n<li><strong>Unklare Definition von Pauschalreisen<\/strong> \u2013 Die neuen Vorschriften f\u00fcr Dienstleistungen, die innerhalb von 24 Stunden gebucht werden, k\u00f6nnten zu Rechtsunsicherheit f\u00fchren, die Grenze zwischen Pauschalangeboten und Einzelleistungen verwischen und die Preisgestaltung erschweren.<\/li>\n\n\n\n<li><strong>Unzureichende Harmonisierung<\/strong> \u2013 Die ECTAA ist der Ansicht, dass noch nicht genug getan wurde, um eine Angleichung an andere Rechtsrahmen zu erreichen, insbesondere im Hinblick auf R\u00fcckerstattungen und den Schutz vor Insolvenz.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-sljedeci-koraci\">N\u00e4chste Schritte<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Die \u00dcberarbeitung der Richtlinie tritt nun in ihre n\u00e4chste Phase ein. <strong>informelle Gespr\u00e4che zwischen dem Europ\u00e4ischen Parlament, dem Rat der EU und der Europ\u00e4ischen Kommission<\/strong>, wo ein Kompromiss \u00fcber den endg\u00fcltigen Text erzielt werden soll.
